Five steps before choosing action
- Check the parties in the judgment. Does it concern the entity identified in the agreement and invoice? Prepare current registration details and preserve the name used during proceedings. Do not assume liability transfers to a different company with a similar name.
- Organise dates and court papers. Record commencement, judgment and known appeal information. Include records of service of the claim and judgment. Do not recreate missing dates from memory; flag them for verification.
- Gather court documents. Preserve the full judgment and available records concerning its effect or enforceability. A lawyer should identify necessary copies and translations. A screenshot should not be treated as a complete enforcement pack.
- Separate the outstanding balance from the award. Reconcile subsequent payments, settlements and adjustments. Record currency, interest and costs as stated in the judgment. Do not add arbitrary recovery charges.
- Request a plan for Poland. A review should identify the possible basis, necessary documents, procedure and costs by stage. Separate assessment of the judgment from assessment of the prospects of collecting from the debtor's assets.
Identify the source and date of any asset information you already hold. An office photograph or an active business profile does not establish sufficient recoverable assets. Keep confidential records away from an unverified provider advertising automatic enforcement throughout Europe.
Creditor questions
Will I have to prove the entire invoice claim again? That depends on the available route. A review of recognition or enforcement differs from starting a fresh claim about the underlying obligation.
Does a final judgment guarantee payment? No. The court records, available procedure and financial position of the debtor are separate parts of the assessment.
Does an old judgment mean the matter is over? Its age alone does not answer that question. Ask a lawyer to assess the possible enforcement basis and relevant time limits before deciding.
