Complaining About a Polish Insurer: Rzecznik Finansowy, KNF and Other Options

Your Polish insurer has refused to pay out, has lowballed your claim, and answers "no" to everything you write. You don't have to go straight to court. There are several free, or low-cost, ways to resolve the dispute outside the courtroom. The Rzecznik Finansowy (Financial Ombudsman), mediation, and, as a last resort, the Komisja Nadzoru Finansowego — KNF (Polish Financial Supervision Authority) — each serve a different purpose. Below we explain when to use which, and how to make a complaint that actually gets somewhere.
Rzecznik Finansowy — free mediation and intervention
The Rzecznik Finansowy (Financial Ombudsman) is an independent public body that supports consumers in disputes with financial institutions — insurers included.
What the Rzecznik Finansowy can do for you

How to file a complaint with the Rzecznik Finansowy
Online (most convenient)

- Click "Złóż skargę" ("File a complaint") or "Formularz reklamacyjny" ("Complaint form")
- Complete the form with: - Your personal details (name, surname, PESEL — the Polish national ID number) - The insurer's details - A description of the problem - Supporting documents (the insurer's decision, invoices, correspondence)
By post (registered letter)

Komisja Nadzoru Finansowego (KNF) — supervision, not compensation
The Komisja Nadzoru Finansowego (KNF, the Polish Financial Supervision Authority) is a regulator for the financial market — its role is quite different from the Ombudsman's.

When it's worth complaining to KNF
Complaining to KNF won't put money in your pocket, because KNF cannot award you anything. But it's still worth filing a complaint if:
- The insurer is breaking the law (e.g. not responding to a complaint within the statutory 30 days)
- The problem affects the whole industry (e.g. every insurer applies the same unfair practice)
- You want to create a paper trail of the wrongdoing, for the Ombudsman or a court
How to complain to KNF

Choose "Skargi i wnioski" ("Complaints and requests") and complete the form — but be aware that KNF is very unlikely to step in on your individual case.
Insurance arbitration (⚠️ very rarely used)
Poland's system technically allows for — though almost nobody actually uses — an insurance arbitrator: a mediator who resolves disputes through an out-of-court arbitration process.
⚠️ Important: this is a largely dormant mechanism — very few insurers honour it. Before investing any time, check:
- Whether your insurer is registered with the arbitration scheme
- Whether your policy contains an arbitration clause
If either is missing, arbitration is effectively unusable for your case.
Mediation — resolving the dispute out of court
Mediation is a structured conversation between you and the insurer, guided by a neutral mediator.
Advantages
✅ Fast (typically 2–4 weeks) ✅ Cheaper than court (a mediator typically charges PLN 200–800) ✅ Confidential (the discussions aren't public) ✅ Flexible (you can negotiate more than just money)
Drawbacks
❌ The insurer doesn't have to agree to mediate ❌ A mediator cannot rule on the case — only help both sides find common ground ❌ If it doesn't work out, you still end up in court
How to set up mediation

Propose mediation to the insurer in writing: - "I propose an out-of-court resolution of this dispute through mediation. I am willing to share the cost of mediation."

Frequently asked questions
Can the Rzecznik Finansowy force an insurer to pay out? Not directly — but its opinion carries real weight, and insurers generally take note of it. If an insurer simply ignores the Ombudsman's view, going to court is your next step.
How much does a complaint to KNF cost? Nothing — it's free. But it bears repeating: KNF will not get you any money.
Does a complaint to the Rzecznik Finansowy pause the limitation period? ⚠️ In principle, no — your claim still becomes time-barred after the usual three-year period, regardless. But the time the Ombudsman spends gathering material can indirectly work in your favour. It's best not to leave things to the last minute.
Can I complain to the Rzecznik Finansowy and go to court at the same time? Yes, you can pursue both. In practice, though, it's usually better to give the Ombudsman a chance first (allow around four months), and only go to court if that doesn't resolve things.
Can an insurer refuse mediation? Yes — mediation is voluntary, not compulsory. If the insurer refuses, court is your remaining option.
